Terms of Use

These Terms of Use (“Terms”) govern your use of Biowiz HabitTracker (“the App”), developed and operated by Ritwiz Swarnkar (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device you own or control, for your personal, non-commercial use, in accordance with Apple’s App Store Terms of Service.

2. Accounts and Data

You are responsible for the accuracy of the information (habit names, schedules, and other content) you enter into the App. The App uses your personal iCloud account for data storage and sync; we do not control or have access to your iCloud account.

3. Subscriptions and Purchases

Auto-Renewable Subscription

The App offers an Annual subscription plan. This subscription:

  • Automatically renews at the end of each billing period unless canceled at least 24 hours before the current period ends.
  • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage or cancel your subscription at any time via Settings → [Your Name] → Subscriptions on your device, or through the App’s Settings → Manage Subscription.
  • If a free trial is offered, any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.

Lifetime Purchases

The App also offers one-time, non-consumable Lifetime purchases at both a regular price and a discounted price for students. The discounted price requires providing a valid email address as described in our Privacy Policy. We reserve the right to verify eligibility for discounted pricing and to revoke access obtained through fraudulent means.

Pricing

Prices are displayed in the App and may vary by region, consistent with Apple’s App Store pricing tiers. We may change prices at any time; changes will not affect purchases already completed.

Refunds

All purchases are billed through Apple. Refund requests must be directed to Apple via reportaproblem.apple.com, in accordance with Apple’s refund policies. We do not process refunds directly.

4. Coupon Codes

Coupon codes distributed by us are:

  • Single-use unless otherwise stated
  • Non-transferable
  • Have no cash value and cannot be exchanged for cash
  • Subject to revocation if used fraudulently or in violation of these Terms

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or tamper with the App
  • Circumvent or exploit the App’s purchase, coupon, or subscription systems
  • Interfere with the App’s normal operation or other users’ use of the App

6. Health Data Disclaimer

The App displays Activity Ring data sourced from Apple Health for informational purposes only. The App does not provide medical advice, diagnosis, or treatment, and the “Close Rings” habit and related display are not a substitute for professional medical guidance. Consult a qualified healthcare provider for any health-related decisions.

7. Intellectual Property

The App, including its design, graphics, logos, and underlying code, is owned by us and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding beyond what’s necessary to use the App as intended.

8. Termination

We reserve the right to suspend or terminate your access to the App, including revoking Pro access obtained through fraudulent coupon use or other violations of these Terms, without prior notice.

9. Disclaimer of Warranties

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the App will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising from your use of or inability to use the App.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of India, without regard to its conflict of law principles.
